Business Torts and
How They Impact Business Owners

Description

A tort is a negligent or intentional civil wrong not arising from breach of a contract or statute. Unlike the contract obligations we voluntarily assume in our daily business affairs, we take on liability for misconduct whether willingly or not. Unlike statutory misconduct which is bad because it is against the law (malum prohibitum), torts are bad because by tradition we all agree they are wrong in themselves (malum in se). When behavior falls short of what society requires, and results in injury or harm, the law recognizes the basis for a tort claim by the injured party. While some torts are also crimes punishable by fine or imprisonment, the primary aim of tort law is to provide relief for the damage incurred. This course will discuss several common business torts along with the liability associated with negligent or intentional misconduct.

Intended audience

This material is intended for anyone wishing to better understand the how tort law affects businesses. Course is designed for in-house and contract thermographers as well as business owners and entrepreneurs.

Instructor

Robert J. Incollingo is a member of the New Jersey State Bar Association and its Public Contract and Construction Section. He is also a member of the Burlington County Bar Association, the Camden County Bar Association, and the Unified State Bar of California. He serves as commercial arbitrator by appointment of the New Jersey Superior Court in Burlington, Camden and Mercer Counties, and as a volunteer mediator for the Superior Court Special Civil Part.  Mr. Incollingo is a contributing author to “Residential Construction & Renovation:  A Legal Guide for New Jersey Homeowners” published by the New Jersey State Bar Foundation.

Mr. Incollingo has been an invited speaker at IR/INFO since 2001.
